All services are provided as described during client onboarding and outlined in any service agreement or proposal documents. Customizations or revisions beyond the agreed scope may incur additional charges.
4. Payment Terms
Fees for our services are communicated upfront and must be paid in accordance with the terms outlined in the invoice or agreement. We accept various forms of payment including credit cards and ACH transfers.
- All payments are non-refundable unless otherwise stated in writing.
- Late payments may result in service suspension or cancellation.
5. Client Responsibilities
Clients agree to:
- Provide accurate and complete information required for service delivery
- Respond to requests in a timely manner
- Comply with all applicable laws and regulations related to marketing, data privacy, and communication
6. Intellectual Property
All content, designs, and deliverables created by Mile High Click remain the intellectual property of the company until full payment is received. Upon payment, ownership of custom assets (e.g., websites, logos) is transferred to the client unless otherwise specified in the contract.
Clients may not reuse, copy, or resell any proprietary tools or frameworks developed by us without prior written consent.
7. Confidentiality
Both parties agree to maintain the confidentiality of proprietary or sensitive information shared during the course of the project, including business strategies, customer data, and pricing structures.
8. Termination
Either party may terminate the agreement with written notice. Any fees for work already completed will be due immediately. We reserve the right to terminate services at any time for misuse, nonpayment, or breach of these terms.
9. Limitation of Liability
We are not liable for any indirect, incidental, special, or consequential damages resulting from the use of our services, including lost profits, business interruptions, or data loss. Our total liability will not exceed the amount paid to us in the 30 days prior to the claim.
10. Warranties Disclaimer
We do not guarantee specific results (such as lead quantity or revenue increase) as marketing outcomes vary. All services are provided “as is” without warranties of any kind, either express or implied.
11. Third-Party Tools & Integrations
We may use third-party tools and platforms (e.g., Google Ads, Facebook, CRM systems) to deliver services. We are not responsible for outages, changes, or issues caused by those platforms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. Any disputes will be resolved in the courts located in Arvada, Colorado.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. Updates will be posted on this page with the revised effective date. Continued use of our services after changes constitutes acceptance of those changes.
